Election Commission of Pakistan decides to hold Senate elections

ISLAMABAD ( March 02, 2021): The Election Commission of Pakistan has decided to follow the opinion of the Supreme Court regarding the Senate elections. Has decided to do A statement issued by the Election Commission said that a detailed decision of the Supreme Court has been received.

The Supreme Court ruled that the Senate elections would be held by secret ballot. The Supreme Court said that transparent election is a responsibility under Article 218 III. The ECP said in a statement that due to lack of time, the March 3 elections would be held under the existing constitution and law. It may be recalled that the Supreme Court in its opinion on the Senate elections yesterday said that the elections to the Upper House would be held by secret ballot. A five-member larger bench headed by Chief Justice Gulzar Ahmed gave its opinion at the rate of four to one. The bench hearing the reference included Chief Justice Gulzar Ahmed, Justice Mushir Alam, Justice Umar Ata Bandial, Justice Ijaz-ul-Ahsan and Justice Yahya Afridi.

Justice Yahya Afridi disagreed with the opinion of other judges. He said the Senate should not comment on the presidential reference to the election. Other judges on the bench said that the Senate elections would be held under Article 226 of the Constitution. It should be noted that Article 266 of the Constitution clearly states that the Senate elections will be held by secret ballot. The Supreme Court said that secrecy is not final, the Election Commission should stop corrupt practices. The Election Commission is bound by the Constitution to hold clean, transparent and fair elections. All the institutions of the country are bound to cooperate with the Election Commission.
